“James Dale, the plaintiff in the landmark Supreme Court case Boy Scouts of America v. Dale, has obtained a memorandum of understanding between the U.S. Department of Defense and Scouting America. The Department handed it over just three weeks after Dale sued for it — without a fight, briefing, or argument.”
